PLEASE READ THIS END USER LICENSE AGREEMENT (THIS “AGREEMENT”) CAREFULLY BEFORE ACTIVATING, DOWNLOADING, INSTALLING OR OTHERWISE USING THIS SOFTWARE PROVIDED BY MADE SARL. THIS AGREEMENT IS A LEGAL AGREEMENT BETWEEN YOU AND MADE SARL.

BY ACTIVATING, DOWNLOADING, INSTALLING, OR OTHERWISE USING THIS SOFTWARE, YOU ARE CONFIRMING YOUR ACCEPTANCE OF THIS SOFTWARE AND ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT. YOU MUST LICENSE THIS SOFTWARE ACCORDING TO A PAID SUBSCRIPTION PLAN OR FREE TRIAL OFFERED BY MADE SARL.

IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, YOU MAY NOT ACTIVATE, DOWNLOAD, INSTALL, OR OTHERWISE USE THIS SOFTWARE AND YOU MUST RETURN IT FOR A REFUND WITHIN THE TIME PERMITTED BY THE TERMS OF YOUR PURCHASE.

IF THIS SOFTWARE WAS ACCESSED ELECTRONICALLY AND YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, CLICK THE “DISAGREE/DECLINE” OR “CANCEL” BUTTON AND DO NOT ACTIVATE, DOWNLOAD, INSTALL OR OTHERWISE USE THIS SOFTWARE.

INTRODUCTION

This License Agreement End user (the “Agreement”) constitutes a contract between you (natural person or single moral person) and MADE who relates to the Software identified below, which can itself include Software components, supports, printed documents and of documentation “on line” or under electronic format (all these elements being named “the Software”).
At the time of the installation, of the copy, or by using the Software in some manner that it is, you recognize being bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, you should neither install nor to use the Software.
MADE SARL reserves the right to update these Terms of Use at any time without the requirement of any notice to you.

The Software is protected by copyright and intellectual laws and international copyright treaties.
All property rights and in particular authors rights relating to the Software and any copy of this one, are held by MADE limited liability company or its suppliers.
All them relative intellectual property laws and other rights with the contents to which the Software can give access, are held by the respective owners of these contents and can be protected by the regulation and the international treaties as regards royalty or of intellectual property . This Agreement concedes you no right to use these contents. All rights not expressly conceded are reserved by MADE SARL.

The SOFTWARE is not sold but he is conceded under license.

LICENSE

The license of the Software under reference is conceded in the following way:

• Installation and Use: MADE SARL concedes you the right to install and use copies of the Software on your computers which make function specimens under valid license of operating systems for which the Software was conceived and which is specified on the documentation of the software.
• Backup copies: You are authorized to make copies of the Software only for needs for safeguard or personal filing.

 
RIGHTS AND RESTRICTIONS

• Maintenance of the mentions of copyright: You are not authorized to remove or modify the mentions of copyright on copies of the Software.
• Distribution: You are not authorized to distribute copies of the Software to thirds.
• Prohibition relating to engineering with wrong way, the decompilation and dismantling: You are not authorized to reconstitute the logic of the Software, to decompile or to disassemble it, except insofar as these operations would be expressly allowed by the applicable regulation notwithstanding the present limitation.
• Hiring: You are not authorized to lend or give in hiring the Software.
• Transfer: You are authorized to transfer the unit from your rights envisaged by this Agreement only if the recipient accepts the terms of them.
• Services of assistance: MADE SARL can, if necessary, provide you services of assistance relating to the Software (“Services of Assistance”). The use of the Services of Assistance is governed by the rules and programs of MADE described in the user manual, documentation “on line” and/or in other documents provided by MADE SARL. Any additional software code which would be provided to you within the framework as of Services of Assistance must be regarded as an element of the Software and is subjected under the terms of this Agreement.
• Personal informations: With regard to the technical informations which you provide to MADE SARL within the framework as of Services of Assistance, MADE SARL will be able to use this information for the needs for its marketing activity, in particular for the assistance on products and the development of products. MADE SARL will not use these technical informations in form which would identify you personally.
• Respect of the applicable laws: You must respect all the applicable laws with regard to the use of the Software.

LIMITED WARRANTY

In all the measurement permitted by the regulations in force, MADE SARL or its suppliers will not be able to in no case to be held for persons in charge of any damage, some nature that it is, (in particular and in a non-restrictive way, any loss of benefit, interruption of activity, loss of commercial information or any other pecuniary loss) resulting from the use or impossibility of using the Software or the supply or the defect of supply of the Services of Assistance, even if MADE SARL were prevented possibility of such damage. In any event, the total responsibility for MADE SARL under any stipulation of this contract could not exceed the amount that you actually paid for the Software.

CANCELLATION

Without prejudice to all other rights, MADE SARL will be able to cancel this Agreement if you do not respect the terms of them. In this case, you will have to destroy all the specimens of the Software.

GOVERNING LAW & JURISDICTION

This Agreement is governed by the French laws.
